By accessing or using Actionpackd ("the Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the Service.

2. Description of Service

Actionpackd provides a platform for businesses to send automated WhatsApp messages, notifications, and broadcasts through the Meta WhatsApp Cloud API. The Service includes campaign management, contact management, message templates, analytics, and AI-powered conversational agents.

3. Account Registration

  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 18 years old to use the Service.
  • One person or business entity per account unless otherwise agreed.

4. Acceptable Use

You agree NOT to use the Service to:

  • Send spam, unsolicited messages, or messages without proper consent
  • Violate Meta's WhatsApp Business Policy or Commerce Policy
  • Send illegal, harmful, threatening, abusive, or harassing content
  • Impersonate any person or entity
  • Distribute malware or engage in phishing
  • Violate any applicable local, state, national, or international law
  • Infringe upon intellectual property rights of others

5. WhatsApp Business Policy Compliance

You are responsible for ensuring your use of the Service complies with Meta's WhatsApp Business Policy, including obtaining proper opt-in consent from message recipients. Violation of Meta's policies may result in suspension of your WhatsApp Business Account and/or termination of your Actionpackd account.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any downtime or service interruptions.

7. Fees and Payment

  • Free tier includes limited message volume as described on our pricing page.
  • Paid plans are billed monthly or annually as selected.
  • WhatsApp conversation charges from Meta are passed through at cost.
  • All fees are non-refundable unless otherwise stated.

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Actionpackd and is protected by copyright, trademark, and other intellectual property laws. You retain ownership of any content you upload or create through the Service.

9. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, Meta's policies, or for any other reason at our sole discretion. You may cancel your account at any time through your account settings or by contacting support.

10. Limitation of Liability

To the maximum extent permitted by law, Actionpackd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities arising from your use of the Service.

11. Indemnification

You agree to indemnify and hold harmless Actionpackd from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on this page. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
